A. Willow West Properties ("Owner"), a co-part- <br />nership, was the owner of approximately three hundred forty- <br />eight (348) acres of real property ("Willow West Property") <br />in the City of Pleasanton, State of California. The Willow <br />West Property is more fully described in Exhibit A to <br /> <br />Exhibit 1 attached hereto. <br /> <br />B. On July 24, 1979, City and Owner entered an <br />Agreement ("Agreement"), a copy of which is attached hereto <br /> <br />as Exhibit 1. The Agreement provided that City and Owner <br />had certain rights, obligations and interests in the Stage <br />3A expansion of the Dublin San Ramon Services District <br />("DSRSD") sewage treatment facilities ("DSRSD Expansion"), <br />and the related expansion of the Livermore-Amador Valley <br />Water Management Agency ("LAVWMA") pumping and outfall line <br />facilities ("LAVWMA Expansion"), described in the Agree- <br />ment. The DSRSD Expansion is designed to create additional <br />sewage treatment capacity in the amount of Five Hundred <br />Thousand (500,000) gallons average day dry weather flow for <br />the benefit of City. The LAVWMA Expansion is designed to <br />create additional sewage disposal capacity in the amount of <br />Five Hundred Thousand (500,000) gallons average day maximum <br />month flow for the benefit of the City. The DSRSD Expansion <br />and the LAVWMA Expansion are hereinafter collectively re- <br />ferred to as the "DSRSD-LAVWMA Expansions". The capacity <br />created by the LAVWMA Expansion, and therefore the concomi- <br />tant use of the DSRSD Expansion, (collectively, <br /> <br />K234-20-A/Sep08 <br /> <br /> <br />
