HANSEN and ANN MARIE MIX (jointly "Owner"), <br />PONDEROSA HOMES, a general partnership ("Ponderosa"), and CITY OF <br />PLEASANTON, a municipal corporation ("City"). <br /> <br /> 1. Owner will sell and convey to Ponderosa and Ponderosa will <br />purchase from Owner the property described on Exhibit "A" attached <br />hereto and made a part hereof by reference (the "Subject Property"). <br /> <br /> 2. Ponderosa has heretofore purchased and acquired from the <br />Dublin-San Ramon Sewer District pursuant to the 1972 Settlement <br />Agreement sewer permits for utilization in connection with certain <br /> <br />lands of Owner, which lands are under option to purchase by Pon- <br />derosa, and which lands include~ inter alia, the Subject Property. <br /> <br /> · 3. Ponderosa hereby covenants and agrees for itself, its <br />successors and assigns, that in connection with the development and <br />improvement of the Subject Property, Ponderosa will allocate and <br />utilize 77 purchased sewer permits. With respect to the remaining <br />property still tinder option but not yet purchased from Owner, <br />Ponderosa retains 633 purch,~sed sewer permits. <br /> <br /> <br />
