CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 82-377 ACCEPTANCE OF OUITCLAIM DEED FOR SUBTERRANEAN WATER AND QUITdLAIM OF CITY RIGHTS OF SURFACE ENTRY FOR TRACT 5099, LINVALE, UNIT 4, SUTTER GATE JOINT VENTUP~ W~IEREAS, the City is in receipt of a Quitclaim Deed from Sutter Gate Joint Venture to the City of Pleasanton for subterranean waters, without rights of surface entry, which is given in exchange for a Quitclaim Deed from the City of Pleasanton to Sutter Gate Joint Venture for surface entry rights and easements, if any, related to the extraction of water; and WHEREAS, at its meeting of SeDtember 13, 1983, the City Council received a report from the Director of Public Works and Utilities indicating that the exchange of these deeds is in the public interest; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Authorizes the mayor to execute the 0uitclaim Deed from the City of Pleasanton to Sutter Gate Joint Venture for surface entry rights and easements, if any, related to the extraction of water in Tract 5099, Linvale, Unit 4. Section 2: Accepts a Quitclaim Deed from Sutter Gate Joint Venture to the City of Pleasanton for subterranean waters, without rights of surface entry for Tract 5099, Linvale, Unit 4, and the aDproDriate city officers are instructed to take whatever action necessary to imDlement said acceptance. Section 3: This resolution shall become effective immediately upon its passage and adoption.
