CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 82-377 <br /> <br />ACCEPTANCE OF OUITCLAIM DEED FOR SUBTERRANEAN <br />WATER AND QUITdLAIM OF CITY RIGHTS OF SURFACE <br />ENTRY FOR TRACT 5099, LINVALE, UNIT 4, SUTTER <br />GATE JOINT VENTUP~ <br /> <br />W~IEREAS, <br /> <br />the City is in receipt of a Quitclaim Deed from <br />Sutter Gate Joint Venture to the City of Pleasanton <br />for subterranean waters, without rights of surface <br />entry, which is given in exchange for a Quitclaim <br />Deed from the City of Pleasanton to Sutter Gate <br />Joint Venture for surface entry rights and easements, <br />if any, related to the extraction of water; and <br /> <br />WHEREAS, <br /> <br />at its meeting of SeDtember 13, 1983, the City <br />Council received a report from the Director of <br />Public Works and Utilities indicating that the <br />exchange of these deeds is in the public interest; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: <br /> <br /> Authorizes the mayor to execute the 0uitclaim <br />Deed from the City of Pleasanton to Sutter Gate <br />Joint Venture for surface entry rights and easements, <br />if any, related to the extraction of water in Tract <br />5099, Linvale, Unit 4. <br /> <br />Section 2: Accepts a Quitclaim Deed from Sutter Gate Joint <br /> Venture to the City of Pleasanton for subterranean <br /> waters, without rights of surface entry for Tract <br /> 5099, Linvale, Unit 4, and the aDproDriate city <br /> officers are instructed to take whatever action <br /> necessary to imDlement said acceptance. <br /> <br />Section 3: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED SEPTemBER 13, 1983 BY THE FOLLOWING <br />VOTE: <br /> <br />AYES: Councilmembers - Brandes, Mercer, Mohr and Mayor Butler <br />NOES: None <br />ABSENT: Councilmember Wood <br /> <br />ATTEST: <br /> <br />By Doris George, Deputy City Clerk <br /> <br /> <br />
