CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 83-360 RESOLUTION VACATING PORTIONS OF OLD HOPYARD ROAD I~HEREAS, at its meeting of August 23, 1983, the City Council received a staff report recormnending the vacation of portions of Old Hopyard Road, more particularly described in Exhibit "A", attached hereto and incorporated herein by this reference; and WHEREAS, the proposed vacation of Old Hopyard Road is consistent with the goals and policies of the General Plan; and WHEREAS, the City Council determines that the above-described portion of Old Hopyard Road is unnecessary for present or prospective public use upon relocation of the utilities presently existing therein; and WHEREAS, access shall not be cut off to any person's property which, prior to relocation, adjoined the street being vacated; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Pursuant to Chapter 4 of the Streets and Highways Code and based upon the findings above establishing the relocation of Hopyard Road in a manner meeting the requirements of Section 8335 of the Streets and Highways Code, that portion of Old HoDyard Road described in Exhibit "A" is hereby vacated subject to the following conditions: that all utilities located within the portion of Old Hopyard Road to be vacated shal~ be relocated in accordance with the Johnson (Owens) Drive-Hopyard Road intersection improvement plans; and that all easements necessary for the relocated utilities be secured. Section 2: The clerk shall cause a certified copy of this resolution of vacation to be recorded in the office of the Alameda County Recorder only UPOn satisfaction of the above conditions. Section 3: This resolution shall become effective immediately upon its passage and adoption.
