CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 83-360 <br /> <br />RESOLUTION VACATING PORTIONS OF OLD HOPYARD ROAD <br /> <br />I~HEREAS, <br /> <br />at its meeting of August 23, 1983, the City Council <br />received a staff report recormnending the vacation <br />of portions of Old Hopyard Road, more particularly <br />described in Exhibit "A", attached hereto and <br />incorporated herein by this reference; and <br /> <br />WHEREAS, <br /> <br />the proposed vacation of Old Hopyard Road is <br />consistent with the goals and policies of the <br />General Plan; and <br /> <br />WHEREAS, <br /> <br />the City Council determines that the above-described <br />portion of Old Hopyard Road is unnecessary for <br />present or prospective public use upon relocation <br />of the utilities presently existing therein; and <br /> <br />WHEREAS, <br /> <br />access shall not be cut off to any person's property <br />which, prior to relocation, adjoined the street <br />being vacated; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: <br /> <br /> Pursuant to Chapter 4 of the Streets and Highways <br />Code and based upon the findings above establishing <br />the relocation of Hopyard Road in a manner meeting <br />the requirements of Section 8335 of the Streets <br />and Highways Code, that portion of Old HoDyard <br />Road described in Exhibit "A" is hereby vacated <br />subject to the following conditions: <br /> <br />that all utilities located within the portion <br />of Old Hopyard Road to be vacated shal~ be <br />relocated in accordance with the Johnson <br />(Owens) Drive-Hopyard Road intersection <br />improvement plans; and <br /> <br />that all easements necessary for the relocated <br />utilities be secured. <br /> <br />Section 2: <br /> <br /> The clerk shall cause a certified copy of this <br />resolution of vacation to be recorded in the <br />office of the Alameda County Recorder only UPOn <br />satisfaction of the above conditions. <br /> <br />Section 3: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> <br />
