CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFO~IIA <br /> <br />RESOLUTIO?] NO. 83-359 <br /> <br />RESOLUTION VACATING PORTIONS OF HOPYARD ROAn <br /> <br />WHEREAS, <br /> <br />on August 23, 1983, the City Council received a <br />staff report recommending the vacation of portions <br />of Hopyard Road and the public service easement <br />adjacent thereto, more particularly described in <br />Exhibit "A", attached hereto and incorporated <br />herein by this reference; and <br /> <br />~tEREAS, the proposed relocation of HoDyard Road is consistent <br /> with the goals and policies of the General Plan; and <br /> <br />WHEREAS, <br /> <br />the suDerseded portion of Hopyard Road is no longer <br />necessary for present or prospective public use due <br />to relocation of the street westward; and <br /> <br />WHEREAS, <br /> <br />access shall not be cut off to any person's property <br />which, prior to relocation, adjoined the street being <br />vacated; and <br /> <br />WHEREAS, <br /> <br />the date of dedication of the public service easement <br />was between one and five years preceding the proposed <br />vacation and the easement has not been used since it <br />was dedicated; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASA~YTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Pursuant to Chapter 4 of the Streets and Highways <br /> Code and based upon the findings above establishing <br /> the relocation of Hopyard Road in a manner meeting <br /> the requirements of Section 8335 of the Streets and <br /> Highways Code, those portions of Hopyard Road described <br /> in Exhibit "A" are hereby vacated. <br /> <br />Section 2: Pursuant to Chapter 4 of the Streets and tlighways <br /> Code and based upon the findings above establishing <br /> the necessity to vacate the Dublic service easement <br /> in a manner meeting the requirements of Section 8333 <br /> of the Streets and Highways Code, those portions of <br /> the public service easement described in Ehxibit "A" <br /> are hereby vacated. <br /> <br />Section 3: <br /> <br /> The clerk shall cause a certified copy of this <br />resolution of vacation to be recorded in the office <br />of the Alameda County Recorder. <br /> <br />Section 4: This resolution shall become e~fective immediately <br /> upon its passage and adoption. <br /> <br /> <br />
