CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFO~IIA RESOLUTIO?] NO. 83-359 RESOLUTION VACATING PORTIONS OF HOPYARD ROAn WHEREAS, on August 23, 1983, the City Council received a staff report recommending the vacation of portions of Hopyard Road and the public service easement adjacent thereto, more particularly described in Exhibit "A", attached hereto and incorporated herein by this reference; and ~tEREAS, the proposed relocation of HoDyard Road is consistent with the goals and policies of the General Plan; and WHEREAS, the suDerseded portion of Hopyard Road is no longer necessary for present or prospective public use due to relocation of the street westward; and WHEREAS, access shall not be cut off to any person's property which, prior to relocation, adjoined the street being vacated; and WHEREAS, the date of dedication of the public service easement was between one and five years preceding the proposed vacation and the easement has not been used since it was dedicated; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASA~YTON RESOLVES AS FOLLOWS: Section 1: Pursuant to Chapter 4 of the Streets and Highways Code and based upon the findings above establishing the relocation of Hopyard Road in a manner meeting the requirements of Section 8335 of the Streets and Highways Code, those portions of Hopyard Road described in Exhibit "A" are hereby vacated. Section 2: Pursuant to Chapter 4 of the Streets and tlighways Code and based upon the findings above establishing the necessity to vacate the Dublic service easement in a manner meeting the requirements of Section 8333 of the Streets and Highways Code, those portions of the public service easement described in Ehxibit "A" are hereby vacated. Section 3: The clerk shall cause a certified copy of this resolution of vacation to be recorded in the office of the Alameda County Recorder. Section 4: This resolution shall become e~fective immediately upon its passage and adoption.
