' ~' "; CITY COUNCIL OF THE CITY OF PLEAS RESOLUTION NO. 83-~5 ames R City Clerk RESOLUTION VACATING A PORTION OF JOHNSON DR~VE ~{EREAS, WHEREAS, on July 26, 1983, the City Council received a staff report recommending the vacation of a portion of Johnson Drive, more particularly described in Exhibit "A", attached hereto and by this reference incorporated herein; and the proposed relocation ~f Johnson Drive is consistent with the goals and policies of the General Plan; and J ~,. WHEREAS, the superseded portion of Johnson Drive is no longer necessary for present or prospective public use due to relocation of the street westward; and WHEREAS, WHEREAS, WIIEREAS, access shall not be cut off to any person's property which, prior to relocation, adjoined the street being vacated; and no public service easements shall be terminated as a result of the proposed vacation; and' public convenience and necessity require the reservation and exception of a public service easement over the entire roadway proposed for abandonment; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Pursuant to Chapter 4 of the Streets and Highways Code and based upon the findings above establishing the relocation of Johnson Drive in a manner meeting the requirements of Section 8335 of the Streets and Highways Code, that portion of Johnson Drive described in Exhibit "A" is hereby vacated subject to the reservation and exception of a public service easement over the entire roadway to be vacated. Section 2: The clerk shall cause a certified copy of the resolution of vacation in the office of the Alameda County Recorder. Section 4: Th~s resolution shall become effective immediately upon its passage and adoption.
