"[ 5 LL'i,.L'X'LD BY <br /> <br /> " ~t,=, t~:=,'j,~q,~ ' ............................................... <br /> ' ~' "; CITY COUNCIL OF THE CITY OF PLEAS <br /> <br /> RESOLUTION NO. 83-~5 ames R <br /> City Clerk <br /> RESOLUTION VACATING A PORTION OF JOHNSON DR~VE <br /> <br />~{EREAS, <br /> <br />WHEREAS, <br /> <br />on July 26, 1983, the City Council received a <br />staff report recommending the vacation of a portion <br />of Johnson Drive, more particularly described in <br />Exhibit "A", attached hereto and by this reference <br />incorporated herein; and <br /> <br />the proposed relocation ~f Johnson Drive is consistent <br />with the goals and policies of the General Plan; <br />and <br /> <br /> J <br />~,. <br /> <br />WHEREAS, <br /> <br />the superseded portion of Johnson Drive is no <br />longer necessary for present or prospective public <br />use due to relocation of the street westward; and <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br />WIIEREAS, <br /> <br />access shall not be cut off to any person's property <br />which, prior to relocation, adjoined the street <br />being vacated; and <br /> <br />no public service easements shall be terminated as <br />a result of the proposed vacation; and' <br /> <br />public convenience and necessity require the <br />reservation and exception of a public service <br />easement over the entire roadway proposed for <br />abandonment; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Pursuant to Chapter 4 of the Streets and Highways <br /> Code and based upon the findings above establishing <br /> the relocation of Johnson Drive in a manner meeting <br /> the requirements of Section 8335 of the Streets <br /> and Highways Code, that portion of Johnson Drive <br /> described in Exhibit "A" is hereby vacated subject <br /> to the reservation and exception of a public <br /> service easement over the entire roadway to be <br /> vacated. <br /> <br />Section 2: The clerk shall cause a certified copy of the <br /> resolution of vacation in the office of the Alameda <br /> County Recorder. <br /> <br />Section 4: Th~s resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> <br />
