7/18/83 - 26630 <br /> <br />Customer may move its primary location within the same <br />Central Office Service Area or any other location in the <br />same Centrex CO Service within, into or outside of the same <br />Central Office Service Area, and the provisions of this <br />Agreement shall apply. All lines involved in a relocation <br />are subject to prevailing nonrecurring charges as defined <br />in Schedule Cal.P.U.C. No. 28-T. <br /> <br />If the Centrex CO Service as set forth in Exhibit A is <br />terminated in whole or in part by Customer or is terminated <br />for cause by the Utility prior to expiration of the Payment <br />Period specified in paragraph 2 above, Customer shall <br />required to pay a sum determined by the application of the <br />following formula for the Centrex CO lines set forth in <br />Exhibit A: <br /> <br /> Number of <br /> Centrex CO Number of <br />Centrex CO Lines on Months <br />Line Exhibit A Below Remaining in <br />Termination 90% Level of Monthly Payment <br />Charge = Commitment X Rate X Period X 50% <br /> <br />13. If Customer wishes to continue service beyond the term of <br /> this Agreement, Customer may elect either: <br /> <br />a. Prevailing month-to-month tariff rates, or <br /> <br />b. If offered, stabilized rates for a fixed term. <br /> <br />Utility agrees not to seek increases in the charges and <br />rates for the service items set forth in Exhibit A <br />(excluding nonrecurring charges) for the Payment Period <br />specified in paragraph 2 above. <br /> <br />-4- <br /> <br /> <br />
