STREET IMPROVEMENT AGREEMENT <br /> <br />VALLEY AVENUE L~DSCAPE IMPROVEMENTS <br /> AND MASONRY SOUNDWALL <br /> SANTA RITA ROAD TO KOLLN STREET <br /> <br />PLEASANTON, ALAMEDA COUNTY, CALIFORNIA <br /> <br />THIS AGREEMENT made and entered at Pleasanton, California this <br /> <br />26th day of July, 1983, by and between: <br /> <br />SENTE ASSOCIATES SEVEN AND <br /> <br />VALLEY BUSINESS ASSOCIATES <br /> <br />5820 STONERIDGE MALL ROAD, SUITE 300 <br /> <br />PLEASANTON, CALIFORNIA 94566 <br /> <br />(hereinafter referred to as "Developer") and the CITY OF PLEASANTON, <br /> <br />a general law city, located in Alameda County, California, acting <br /> <br />through the City Manager and the City Clerk (hereinafter referred to <br /> <br />as "City"). <br /> <br /> WttEREAS, Developer has filed with the City of Pleasanton a <br />Final Subdivision Map for Tract 4889, in the City of Pleasanton; <br />and <br /> <br /> WHEREAS, Developer deaires to improve the access to said <br />subdivision by installing landscape improvements and masonry sound- <br />wall on Valley Avenue between Santa Rita Road and Kolln Street; and <br /> <br /> WHEREAS, Developer is required by Ordinance No. 1084, Major <br />Modification to Case PUD 79-13, to install a masonry soundwall <br />three feet in from the curb line along the eastern boundary of <br />the 30' wide landscape buffer. <br /> <br /> NOW, THEREFORE, in consideration of the faithful performance <br />of the promises, terms, conditions and covenants set forth herein by <br />Developer and the approval of the mad by the City, the parties <br />hereto agreeas follows: <br /> <br /> 1. Time of Essence. Time is of the essence in the performance <br />of this agreement. The work and improvements required by this agree- <br />ment to be completed by Developer shall be completed within one (1) <br />year from the above-mentioned date of this agreement. <br /> <br /> <br />
