WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 83-286 RESOLUTION APPROVING RIGHT-OF-ENTRY AGREEMENT WITH THE U.S. ARMY the City of Pleasanton aDproved the plans and specifications for the improvements of portions of Stoneridge Drive and Santa Rita Road by Prudential Insurance Company of America; and certain portions of require the City to U. S. Department of land; and these roadway improvements secure an easement from the the Army over government owned Prudential wishes to begin construction in advance of receipt of final easements; and the Department of the Army has indicated that they would approve a right-of-entry subject to numerous conditions; and the City deems it in its best interest to enter a right-of-entry agreement with the Department of the Army to enable Prudential to begin construction in a timely manner, and because Prudential has entered into an agreement with the City relieving the City of any adverse consequences of beginning construction prior to receipt of the final easement; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Accepts the terms and conditions in the proposed Right-of-Entry Agreement dated June 24, 1983, attached hereto and incorporated herein as Exhibit A. Section 2: Authorizes the City Manager to execute the above- described agreement. Section 3: This resolution shall become effective immediately upon its passage and adoption.
