EASEMENT AGREEMENT <br /> <br /> THIS IS AN AGREEMENT between Kaiser Foundation Health Plan, Inc., <br /> a California nonprofit public benefit corporation (herein called "Grantor"), <br /> and the City of Pleasanton., a municipal corporation (herein called "Grantee"). <br /> <br /> Grantor, for valuable consideration received, hereby grants to Grantee <br /> a public service easement over, under and across that certain property <br /> situated in the City of Pleasanton, County of Alameda, State of California and <br /> described in the attached Exhibit "l" ("Easement Area"). <br /> <br /> The Easement Area is for the use, maintenance, and repair of a six-inch <br /> domestic and fire service water main which shall be installed by Grantor. <br /> <br /> Said easement is subject to the following covenants and conditions. <br />Grantee's performance and observance of said covenants and conditions, as <br />well as its every exercise of the rights hereby granted, shall always be at <br />Grantee's sole expense and risk: <br /> <br /> 1. Grantee's use of the Easement Area shall be such as to provide a <br />minimum of interference wi{h Grantor~s use of the property. <br /> <br />2. Grantor reserves the right to use the Easement Area for any other <br />purpose which does not interfere with the rights herein granted to the Grantee. <br /> <br /> Grantee's use of the Easement Area shall continue in effect so long as <br />the premises are required by Grantee as specified herein, In the event <br />Grantee abandons the Easement Area, the easement shall thereupon be terminated. <br /> <br /> <br />
