EASEMENT AGREEMENT <br /> <br /> THIS IS AN AGREEMENT between Kaiser Foundation Health Plan, Inc., <br /> <br />a California nonprofit public benefit corporation (herein called "Grantor"), <br /> <br />and the City of Pleasanton~ a municipal corporation (herein called "Grantee"). <br /> <br /> Grantor, for valuable consideration received, hereby grants to Grantee <br />a public service easement over, under and across that certain property <br />situated in tl~le City of Pleasanton, County of Alameda, State of California and <br />described in the attached Exhibit "2" ("Easement Area"). <br /> <br /> The easement is for an eight-foot wide public right-of-way to accommodate <br />a bike pedway to be installed by Grantor. <br /> <br /> Said easement is subject to the following covenants and conditions. <br />Grantee's performance and observance of said covenants and conditions, as <br />well as its every exercise of the right hereby granted, shall always be at <br />Grantee's sole expense and risk: <br /> <br /> 1. Grantee's use of the Easement Area shall be such as to provide a <br />minimum of interference with Grantor's use of the property. <br /> <br />2. Grantor reserves the right to use the Easement Area for any other <br />purpose which does not interfere ~vith the rights herein granted to the Grantee. <br /> <br /> Grantee's use of the Easement Area shall continue in effect so long as <br />the premises are required by Grantee as specified herein. In the event <br />Grantee abandons the Easement Area. the easement shall thereupon be <br />terminated. <br /> <br /> <br />
