nLain[enanc~ will be the responsibility of <br /> Zone 7. City agrees to grant an easement <br /> or license to Zone 7 adjacent to the administra- <br /> tive office Site if aecessary to acconnnodate <br /> said parking area, <br /> h. Tbe Site will be landscaped and maintained in <br /> <br /> a manner con~ensurate with the surrounding <br /> park setting. <br /> <br /> 4. ZoBin8. <br /> <br /> Zone 7 acknowledges and a%rees that development of <br /> <br />the property is subject to City zoning regulations. City agrees <br />to initiate a rezoniug proposal to a zoning district compatible <br />with the proposed use upon request of Zone 7. While prevented <br />by police power limitations from agreein~ to the proposed <br />rezon[ng at this tithe, City declares that it is favorably <br />disposed to the proposed use of the property. In addition, <br /> <br />City is favorably disposed to allocate the appropriate <br /> <br />sewer connection to Zone 7 for the pronosed development. <br />Finally, Zone 7 agrees to submit design plans for the proposed <br />project to City for review pursuant to the City's design <br />review ordinance. Zone 7 will comply with all reasonable <br />requests of the City relating to aesthetics of the project. <br /> <br /> 5. Costs and Attorneys Fees. <br /> <br /> The prevailing party in any action to enforce or construe <br /> <br />the terms of this Agreement may recover from the other party <br />its reasonable costs and attorney's fees exnended in connection <br />with such an action. <br /> <br /> <br />
