EEMENT <br /> <br /> THIS AGREEMENT is executed as of .__ , <br />1983, by and between FOOTHILL ASSOCIATES, a j~nt venture <br />composed of New England ;.lutual Life l'nsurance Company, a <br /> <br />l~lassachusetts cozporatron, and Callyon Associates, a <br /> <br />California general partnership, (hereinafter referred to as <br /> <br />"Foothll 1" ); and TfiE CITY OF PLEASANTON, a municipal <br />corporation (hereinafter referred to as "City"). <br /> <br /> RECITALS <br /> <br /> A, City has undertaken to construct certain <br /> <br />public improvements as part of Assessment District No. <br />19B2-1~ (Duulirl Canyon Road Improvements) including the <br /> <br />widenin9 of Canyon Way adjacent to Foothili's Centerpoinhe <br />development (hereinafter referred to as "Centerpointe" ) <br />located at the northeast corner of Canyon Way and Foothill <br />Road. <br /> <br /> B, Centerpoint, is currently under construction <br />pursuant to City approval granted for Case Z--81-117 and Case <br />Z.-82-]60. Centerpointe includes several buildings which are <br />under construction and a future building pad (hereinafter <br />referred to as "Pad A") for which no final. design approval <br />has been granted and no bui. ldin9 perml. t has been issued ~ <br />all parking and landscaping for the entire development is <br />Dein9 constructed in conjunction with the buildings now <br />under construction, including the parking arid landscaping <br />necessary for the future development on Pad A. <br /> <br /> <br />
