~EREAS, WHEREAS, WHEREAS WHEREAS WHEREAS CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 83-233 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON CONCERNING ORDINANCE NO. 1040 the City Council of the City of Pleasanton on June 22, 1982 adopted Ordinance No. 1040 aDDrovin~ an application to rezone to the PUD District and a development plan for PUD-81-30; and in connection with its adoption of Ordinance No. 1040, the City Council on June 8, 1982 made a finding that PUP-81-30 was consistent with the General Plan of the City of Pleasanton; and on February 8, 1983, the City Council adopted Resolution No. 83-55 concerning the history and meaning of the Growth Management Element of the General Plan of the City of Pleasanton and reaffirming its decision that the development plan for Hacienda Business Park Phase I is consistent with the Pleasanton General Plan; and on March 16, 1983, the Alameda County Superior Court in an action entitled "Citizens for Balanced Growth v. City of Pleasanton", Action No. H-84827-3, issued a Writ of Mandate directing the City Council to vacate and set aside its approval of Ordinance No. 1040 and to file a written return to the Writ on or before June 15, 1983, based on the Court's decision that approval of Hacienda in Ordinance No. 1040 was inconsistent with certain provisions of the Growth Management Element of the Pleasanton General Plan; and on April 26, 1983, a Notice of Preparation was issued by the City of Pleasanton for an Environmental Impact Report covering a ProPosed General Plan Clarification Amendment resolving the issues raised by the Court's interpretation of the General Plan; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Ordinance No. 1040 is hereby set aside in accordance with the Writ of Mandate.
