Re~k.~ed May 13, 1983 <br /> <br />City and its elective and appointive Boards, Commissions, officers, <br />agents and employees from any suits or actions at law oF equity for <br />damages caused, or alleged to have been caused, by reason of any of <br />the aforesaid operations. In addition to the above: <br /> <br />That City does not, and shall not, waive any rights <br />against Developer which it may have by reason of the <br />aforesaid hold-harmless agreement, because of the <br />acceptance by City, or the deposit with City by <br />Developer of any of the insurance Do].icies described <br />herein. <br /> <br />That the aforesaid hold-harmless agreement by Developer <br />shall apply to all damages and claims for damages of every <br />kind suffered, or alleged to have been suffered, by reason <br />of any of the aforesaid operations referred to in this <br />paragraph, regardless of whether or not City has prepared, <br />supplied or approved of, plans or specifications for the <br />subdivision, or regardless of whether or not such insurance <br />policies shall have been determined to be applicable to <br />any of such damages or claims for damac,es. <br /> <br />11. Insurance. Developer further agrees to fu].ful] the following: <br /> <br />Provide a Certificate of Insurance issued to the City <br />of Pleasanton from his insurance carrier providing <br />proof of Worker's Compensation and policy number. <br /> <br />Provide a Certificate of Insurance from his insurance <br />carrier showing the amount of Public Liability and <br />Property Damage coverage and naming the C~ty of Pleasanton <br />and Agents as an additional insured. <br /> <br />Insurance coverage shall be in at least the following amounts: <br /> <br />PUBLIC LIABILITY <br />General Bodily Injury <br />General Property Damqe <br /> Or <br />Combined Single Limit on <br />Damage Liability <br /> <br />$1,000,000 Per Occurrence <br />$ ]00,000 Per Occurrence <br /> <br />Bodily Injury and Property <br /> $1,000,000 <br /> <br />AUTOMOBILE LIABILITY <br />Bodily Injury $500,000 Per Person/S],000,000 Per <br /> Occurrence <br />Property Damage $100,000 Per Occurrence <br /> Or <br />Combined Single Limit on Bodily Injury and Property <br />Damage Liability $1,000,000 <br /> <br /> 12. Attorney's Fees. In the event City shall install and prevail <br />in any action or suit for the enforcement of any of lts rights under <br />this agreement, Developer shall pay to City a reasonable attorney's <br />fee as may be fixed by the court on account thereof. <br /> <br /> <br />
