City, Owners and Kaiser Aetna, a general partnership now <br />dissolved and the predecessor in interest to Ponderosa, made an <br />agreement on November 22, 1971, recorded on August 9, 1972 as <br />Instrument No. 72-108417, Reel 3202, Image 27, et seq., in the <br /> <br />Official Records of Alameda County ("Agreement") respecting certain <br />real property described in the Agreement ("Real Property"). <br /> <br /> B. Ponderosa has purchased from Owners a substantial portion <br />of the Real Property. Ponderosa desires to terminate the effect, if <br />any, of the Agreement with respect to the Real Property and the City <br /> <br />and Owners aoree, <br /> <br />1.
