CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 83-191 <br /> <br />A RESOLUTION OF NECESSITY TO ACQUIRE BY EMINENT <br />DOMAIN PROPERTY NEEDED FOR THE WIDENING OF DUBLIN <br />CANYON ROAD <br /> <br />WHEREAS <br /> <br />to facilitate improvement to the traffic circulation <br />system necessary for the Stoneridge Mall and peripheral <br />developments, a plan for widening Dublin Canyon Road <br />was approved by the Planning Commission and City <br />Council; and <br /> <br />WHEREAS <br /> <br />implementation of the widening of Dublin Canyon Road <br />requires acquisition of Drivate property; and <br /> <br />WHEREAS <br /> <br />notice waa given pursuant to Section 1245.235 of <br />the Code of Civil Procedure of the State of California <br />and a hearing was held at which time Dersons affected <br />had an opportunity to aDpear and be heard; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section <br /> <br />1: The City Council finds that, pursuant to Section <br /> 37350.5 of the Government Code of the State of <br /> California authorizing the City of Pleasanton to <br /> acquire property by eminent domain, all that land <br /> described in Exhibit A, attached hereto is necessary <br /> for public use as a public street. <br /> <br />Section 2: The City Council declares that, with respect to <br /> the proposed widening of Dublin Canyon Road, it has <br /> found and determined that: <br /> <br />(a) the public interest and necessity require the <br /> proposed project; <br /> <br />(b) <br /> <br />the proposed project is planned and located <br />in the manner that will be most compatible <br />with the greatest public good and the least <br />private injury; and <br /> <br />(c) the property described in this resolution is <br /> necessary for the proposed Droject. <br /> <br />Section 3: The City Attorney is hereby authorized and directed <br /> to acquire the above-described real OroDerty in <br /> accordance with the law of eminent domain of the <br /> State of California. <br /> <br /> <br />
