FIRST A~iENDF~ENT TO AGREEF3ENT FOR ENGINEER/NG SERVICES <br />FOR PROPOSED GRADE SEPARATIONS AND TRACK CONSOLIDATION <br />INVOLVING SOUTHE.~N PACIFIC TRANSPORTATION COMP.~NY AND <br />THE WESTERN PACIFIC RAILROAD COMPANY TRACKS BE~'~'EEN <br />NiLaS AND PLEASANTON IN ALAMEDA COUNTY <br /> <br />PkRTIES: <br /> <br /> THIS FIRST AMENDMENT TO AGREEMEhT iS by and between: <br /> <br /> a. The County of Alsaneda, a political subdivision of the State of <br />California, hereinafter referred to as COUNtrY; <br /> <br /> b. The City of Pleasanton, a municipal corporation of the State <br /> <br />of California, hereinafter referred to as CITY; <br /> <br />The aforesaid parties bereinafter collectively called AGENCIES; and <br />c. De Leuw, Cather & Company, Consulting Engineers, an Illinois <br />Corporation, with a place of business at 120 Howard Street, San Francisco, <br />California 94105, hereinafter called ENGINEER. <br /> <br />WITNESSETH: <br /> <br /> WHEREAS, the parties heretofore have entered into an Agreement <br />dated September 28, 1982 for engineering services in connection with <br />three proposed railroad grade separations involving the Southern Pacific <br />Transportation COmpany and the Western Pacific Railroad Company; and <br /> <br /> WHEpaAS, because of earlier boundary errors and conditions beyond <br />the control of the ENGINYER, it has been necessary toperform Extra Work <br />to provide right-of-way drawings and legal descriptions; and <br /> <br /> ~EREAS, the parties therefore have mutually concluded that the <br />Agreement be amended in the manner hereinafter set forth. <br /> <br /> NOW, THEEFOE, IT IS AGPSED BY Tht PkRTIES ERETO AS FCLLOWS: <br /> That Paragraph 4, Section F, COMP~XNSATION, be modified as follows: <br /> <br /> "4. The max{me fees to be paid ENGINTZR for the work will be: <br /> <br /> County of Alameda: $45,500 <br /> City of Pleasanton: $350,500 <br /> <br />Except as hereinabeve specifically provided, all other provisions of the <br />Agreement r~m~in in full force and effect. <br /> <br />1 of 2 <br /> <br /> <br />
