II. DUTIES OF CiTY <br /> <br />The CITY shall: <br /> <br />FurniM; information available from CITY records and services necessary to <br />complete the PROgECT as loIlows: <br /> <br />l. Location o~ all known CITY utilities and underground facilities. <br /> <br />Improvement plans indicating existing and proposed conditions in areas <br />adjacent to the PROgECT, both public and private development. <br /> <br />Current Preliminary Title Report and updated property description~ <br />including all known easements and right-of-way dedications. <br /> <br />Additional cost of plans and specifications in excess of .SO complete sets. <br /> <br />Advertise and award the Contract. <br /> <br />Soils investigation and reports if determined to be needed, <br /> <br />Any other information or services not specifically to be provided by <br />CONSULTANT. <br /> <br />B. Furnish construction observation and inspection for PRO3ECT. <br /> <br />Notify CONSULTANT in writing of any errors omission, or defect the CITY <br />observes in the PROgECT. <br /> <br />lli. MISCELLANEOUS PROVISIONS <br /> <br />This agreement shall be deemed personal to CONSULTANT; and CONSULTANT <br />shall not assign, sublet or transfer this contract or any interest or obligation <br />therein to any third party except to the below-listed sub-consultants without <br /> <br />the prior written consent of CITY, and then only UpOl] such terms and conditions <br /> <br />as CITY may set forth in writing.
