CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 83-132 RESOLUTION DECLARING BID FROM BAY CITIES PAVING AND GRADING FOR FROMM BUSINESS PARK, ASSESSMENT DISTRICT 1982-5, TO BE VALID AND ACCEPTING SUB- STITUTION FOR SUBCONTRACTORS WHEREAS, on March 30, 1983, Bay Cities Paving and Grading, Inc. was awarded the bid for construction of improvements in the Fromm Business Park; and I~HEREAS, within 48 hours, Bay Cities submitted an affidavit indicating clerical errors in the listing of the subcontractors for the project; and WHEREAS, a public hearing was held on April 12, 1983 at which time testimony was taken regarding the validity of the bid and the errors in listing subcontractors; and WHEREAS, the City Council considered the staff report of the City Attorney dated April 5, 1983 along with the protests of two of the subcontractors; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Declares the bid from Bay Cities Paving and Grading for construction on Fromm Business Park, Assessment District 1982-5 is valid on its face. Section 2: Council hereby accepts the substitution of Rosendin Electric of San Jose, California for utility work in place of Duran Jones of Pleasanton and the addition of Rosendin Electric as subcontractor for traffic signalization. Section 3: Council hereby accepts Herzer Landscaping of San Lorenzo, California for all landscaping work in the Assessment District. Section 4: This resolution shall become effective immediately upon its passage and adoption. THIS RESOLUTION ADOPTED APRIL 12, 1983 BY THE FOLLOWING VOTE:
