6. Power equipment operation will be performed only by <br /> qualified City employees. <br /> <br /> 7. City will provide volunteers with safety equipment such <br /> as signs, hard hats and red vests. <br /> <br /> 8. City employees would provide safety instructions, <br /> explain the work to be done and direct the work of the Volunteers. <br /> <br /> 9. In the event that a claim for industrial injury is <br /> filed by a Volunteer working under the direction of Pleasanton, <br /> the County will be responsible for the adminsitration of the <br /> claim in the same manner as if the Volunteer was a County <br /> employee and for all costs incurred in the administration of such <br /> claims including any settlement costs. <br /> <br /> 10. City shall indemnify, hold harmless and defend <br /> <br />County, its agents and employees from any and all actions, <br />claims or suits of every name, kind and description, which <br />may be asserted by any person, including any Volunteer placed <br />by County with City arisin~ out of or in connection with the <br />performance of assigned work by any Volunteersduring the period <br />of custody or control by the City. This indemnification clause <br />does not apply to the extent that limitations on City control <br />of the Volunteer or character propensities of the Volunteer <br />result in any such claim or action and County a~rees to indemnify, <br />hold harmless and defend Pleasanton in that circumstance. <br /> <br /> !1. This agreement shall become effective upon its <br />execution by all of the parties hereto. This agreement may <br />be terminated at any time upon mutual consent of the parties. <br /> <br /> <br />
