AGREEMENT This AGREEMENT, made and entered into this day of , 19 , by and between the COUNTY OF ALAMEDA, State of California, hereinafter called "COUNTY", and the CITY OF PLEASANTON hereinafter called "CITY". WITNESSETH WHEREAS, the CITY desires to contract with the COUNTY for a PIN/CLETS computer terminal, and WHEREAS, Government Code Section 25504 permits the County to lease its equip- ment to another public agency. NOW, THEREFORE, the parties hereto agree as follows: Contract period will be from August l, 1983, and will continue in force until termination by either party at any time by thirty-days written notice. The Data Processing Department of the COUNTY shall provide to the CITY two Police Information Network terminals known as a 3276 CRT, a 3278 CRT and one 3287 model 1 printer, modem and line including eleven-hour maintenance service on subject devices, Monday through Friday, 6:00 a.m. to 7:00 p.m. The CITY shall pay to the COUNTY for this service $470.00 per month. The amount of the payment may be modified annually by COUNTY upon sixty-days written notice to CITY. In addition, a one-time installation charge of $500.00 will be paid to the COUNTY by the CITY. The CITY shall indemnify COUNTY, its officers and employees against lia- bility for injury or damage caused by any negligent act or omission in the performance of this agreement. COUNTY and CITY agree that no person shall, on the grounds of race, creed, color, sex or national origin be excluded from participation in, be denied the benefits of, or otherwise subjected to discrimination under this agreement. 6. This agreement may be modified at any time in writing by mutual agreement of the parties. The CITY shal~ return, upon termination of the agreement, the terminal(s) in good condition subject only to reasonable wear due to normal use.
