~E~AS, <br /> <br />WHEREAS, <br /> <br />~E~AS, <br /> <br />WHEREAS, <br /> <br />CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 83-50 <br /> <br />RESOLUTION DENYING THE APPEAL OF THE CITY COUNCIL <br />AND APPROVING THE APPLICATION OF JAMES CROSS AND <br />TEXACO, INC. FOR A CONDITIONAL USE PERMIT FOR <br />OPERATION OF A SERVICE STATION AT 44 MISSION DRIVE <br /> <br />at its meeting of January 12, 1983, the Planning <br />Commission approved case UP-82-24, the application <br />of James Cross and Texaco, Inc. for operation of a <br />service station, not including the sale of gasoline, <br />at 44 Mission Drive; and <br /> <br />within the time specified by the Ordinance Code of <br />the City of Pleasanton, the City Council appealed <br />the Planning Commission approval; and <br /> <br />at its meeting of February 8, 1983, the City <br />Council reviewed a report dated February 1, 1983 <br />from the Director of Planning and Community <br />Development together with copies of staff reports <br />to the Planning Commission regarding this matter; <br />and <br /> <br />the City Council held a public hearing at which <br />time the applicant and any other member of the <br />public was offered an opportunity to present <br />evidence regarding this appeal; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: <br /> <br /> Denies the appeal of the City Council thereby <br />approving the conditional use permit application <br />of James Cross and Texaco, Inc. for operation of a <br />service station, not including the sale of gasoline, <br />at 44 Mission Drive, subject to all conditions <br />contained in Planning Commission Resolution No. <br />2258. <br /> <br />Section 2: The City Council hereby adopts the following <br /> findings regarding case UP-82-24: <br /> <br />That the proposed location of the conditional <br />use is in accord with the objectives of this <br />chapter and the purposes of the district in <br />which the site is located. <br /> <br /> <br />
