~E~AS, WHEREAS, ~E~AS, WHEREAS, CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 83-50 RESOLUTION DENYING THE APPEAL OF THE CITY COUNCIL AND APPROVING THE APPLICATION OF JAMES CROSS AND TEXACO, INC. FOR A CONDITIONAL USE PERMIT FOR OPERATION OF A SERVICE STATION AT 44 MISSION DRIVE at its meeting of January 12, 1983, the Planning Commission approved case UP-82-24, the application of James Cross and Texaco, Inc. for operation of a service station, not including the sale of gasoline, at 44 Mission Drive; and within the time specified by the Ordinance Code of the City of Pleasanton, the City Council appealed the Planning Commission approval; and at its meeting of February 8, 1983, the City Council reviewed a report dated February 1, 1983 from the Director of Planning and Community Development together with copies of staff reports to the Planning Commission regarding this matter; and the City Council held a public hearing at which time the applicant and any other member of the public was offered an opportunity to present evidence regarding this appeal; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Denies the appeal of the City Council thereby approving the conditional use permit application of James Cross and Texaco, Inc. for operation of a service station, not including the sale of gasoline, at 44 Mission Drive, subject to all conditions contained in Planning Commission Resolution No. 2258. Section 2: The City Council hereby adopts the following findings regarding case UP-82-24: That the proposed location of the conditional use is in accord with the objectives of this chapter and the purposes of the district in which the site is located.
