HOLD HARMLESS AGREEMENT <br /> <br /> WHEREAS, the Fire Department of the City of Pleasanton <br />proposes to stage a controlled burn of the premises at 2726 <br />Santa Rita Road, Pleasanton, California, for purposes of a <br />teaching exercise; and <br /> <br /> WHEREAS, the owner of the property is the Roman Catholic <br />Diocese of Oakland and the property owner has given its <br />permission to burn the structure at 2726 Santa Rita Road. <br /> <br /> NOW, THEREFORE, in consideration of the Roman Catholic <br />Diocese of Oakland allowing the Fire Department to use its <br />premises for a controlled burn, the City of Pleasanton agrees <br />as follows: <br /> <br /> 1. To hold the Roman Catholic Diocese of Oakland, its <br />officers, employees or agents, harmless from claims or <br />actions for death, or injuries to persons or property caused <br />by the Fire Department's controlled burn on its property at <br />2726 Santa Rita Road, Pleasanton, California, presently <br />anticiated to occur in the month of February, 1983. <br /> <br /> 2. To defend the Roman Catholic Diocese of Oakland in <br />the event that any claim listed above is brought against it <br />and pay to it the cost of any and all legal fees, settlements, <br />court costs and judgments that may be rendered against it or <br />which the Diocese decides in its best judgment must be paid. <br /> <br /> This agreement shall terminate upon the completion of <br />the Fire Department Exercise. <br /> <br />-1- <br /> <br /> <br />
