CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 83-14 <br /> <br />RESOLUTION VACATING OLD HOPYARD ROAD <br /> <br />WHEREAS, <br /> <br />on November 23, 1982, the City Council received a <br />staff report recommending the vacation of a portion <br />of Old Hopyard Road, more particularly described <br />in Exhibit "A" attached hereto and by this reference <br />incorporated herein; and <br /> <br />WHEREAS, <br /> <br />on November 23, 1982, Council adopted a resolution <br />of intention to vacate the portion of street; and <br /> <br />WHEREAS, <br /> <br />the appropriate notice was given pursuant to <br />Streets and Highways Code §8300, et seq.; and <br /> <br />WHEREAS, <br /> <br />a public hearing was held at which time the public <br />was given the opportunity to comment on the Droposed <br />vacation of a portion of Hopyard Road; and <br /> <br />WHEREAS, <br /> <br />the City Council determines that the above-described <br />portion of Old Hopyard Road is unnecessary for <br />present or prospective public use upon relocation of <br />the utilities presently existing therein; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: <br /> <br /> That the portion of Old Hopyard Road, more <br />particularly described in the attached Exhibit "A" <br />and incorporated herein by this reference, is <br />hereby vacated upon the satisfaction of the following <br />conditions: <br /> <br />that all utilities located within the portion <br />of Old Hopyard Road to be vacated shall be <br />relocated in accordance with the Johnson (Owens) <br />Drive-Hopyard Road intersection improvement plans; <br />and <br /> <br />that all easements necessary for the relocated <br />utilities be secured. <br /> <br />Section 2: The City Manager is hereby directed that the resolution <br /> of vacation not be recorded until the above conditions <br /> have been satisfied. <br /> <br />THIS RESOLUTION ADOPTED JANUARY 11, 1983 BY THE FOLLOWING <br />VOTE: <br /> <br /> <br />
