CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 83-14 RESOLUTION VACATING OLD HOPYARD ROAD WHEREAS, on November 23, 1982, the City Council received a staff report recommending the vacation of a portion of Old Hopyard Road, more particularly described in Exhibit "A" attached hereto and by this reference incorporated herein; and WHEREAS, on November 23, 1982, Council adopted a resolution of intention to vacate the portion of street; and WHEREAS, the appropriate notice was given pursuant to Streets and Highways Code §8300, et seq.; and WHEREAS, a public hearing was held at which time the public was given the opportunity to comment on the Droposed vacation of a portion of Hopyard Road; and WHEREAS, the City Council determines that the above-described portion of Old Hopyard Road is unnecessary for present or prospective public use upon relocation of the utilities presently existing therein; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: That the portion of Old Hopyard Road, more particularly described in the attached Exhibit "A" and incorporated herein by this reference, is hereby vacated upon the satisfaction of the following conditions: that all utilities located within the portion of Old Hopyard Road to be vacated shall be relocated in accordance with the Johnson (Owens) Drive-Hopyard Road intersection improvement plans; and that all easements necessary for the relocated utilities be secured. Section 2: The City Manager is hereby directed that the resolution of vacation not be recorded until the above conditions have been satisfied.
