CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION N0.83-05 TOWNHOUSES, EXTRACTION OF WATER AND A~CEPTANCE OF QUITCLAIM DEED FROM VALLEY PLAZA APARTMENTS FOR THE SUB- TERRANEAN WATERS WHEREAS, a final subdivision map for Tract 5101, Valley Plaza Townhouses, has been submitted and checked by the Engineering staff and the necessary inspection fees, bonds and agreements received by the Director of Public Works and Utilities; and WHEREAS , in addition, the City is in receipt of a Quitclaim Deed from Valley Plaza Apartments Joint Venture for subterranean waters, Without rights of surface entry, which is given in exchange for a Quitclaim Deed from the City of Pleasanton for surface entry rights and easements, if any, related to the extraction of water, a coDy of which is attached; and WHEREAS, at its meeting of January 11, 1983, the City Council received a report from the Director of Public Works and Utilities indicating that the exchange of these deeds is in the public interest; and WHEREAS, at the same time, Council reviewed the final subdivision map for Tract 5101; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: The final subdivision map for Tract 5101, Valley Plaza Townhouses, is hereby approved and accepted and the appropriate City officers are instructed to take whatever action necessary to implement said approval. Section 2: Authorizes the mayor to execute the Quitclaim Deed from the City of Pleasanton to Valley Plaza Apartments Joint Venture, a copy of which is attached hereto, for surface entry rights and easements, if any, related to the extraction of water in Parcel Map 3821 (Tract 5101). Section 3: Accepts the Quitclaim Deed from Valley Plaza Apartments Joint Venture to the City of Pleasanton, a copy of which is attached hereto as Exhibit "B",
