CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 84-579 <br /> <br />RESOLUTION DECLARING 144 SQ FT OF RIGHT-OF-WAY ON <br />HOPYARD ROAD AS SURPLUS <br /> <br />WHEREAS, <br /> <br />in untangling the ownership of lands involved in the <br />widening of Hopyard Road just south of Owens Drive it <br />became apparent that a small parcel totaling 144 sq. ft. <br />is surplus and the City would like to dispose of the <br />property according to State-mandated procedures; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: The City Council declares the parcel of land <br /> (approximately 144 sq. ft.) on Hopyard Road south of <br /> Owens Drive, more particularly described on the attached <br /> map, as surplus. <br /> <br />Section 2: The City shall notify all agencies required by law to <br /> be given first opportunity to purchase surplus property. <br /> <br />Section <br /> <br />3: The City Council finds that the most appropriate <br />development patter for the area is for use as plottage <br />to the adjacent parcel, provided that the owner of the <br />adjacent parcel is willing to pay the fair market value <br />for this parcel, and authorizes staff to negotiate with <br />the adjacent property owner for purchase of the <br />property. <br /> <br />Section 4: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED NOVEMBER 13, 1984 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - Brandes, <br /> Mercer <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br />ATTEST: <br /> <br />Butler, Mohr, Wood and Mayor <br /> <br />James R. ~alk~, ~i y Ci~rk ~ <br /> George, Deputy City Clerk <br /> <br />~PpROVED~ AS TO FORM: <br />Pe~e'~ D.
