SHEPHERD, <br /> <br />"Shepherd") and lhe CITY OF PLEASANTON, <br /> <br />(hereinafter rel:e. rred to as "City"). <br /> <br /> is made and entered into this day of <br /> <br />71.984, by and between WILLIAM G. SHEPHERD and <br /> <br /> husband and wife (hereinafter referred to as <br /> <br /> a municipal corporation <br /> <br /> RECITALS <br /> <br /> A. Shepherd is the owner of an approximately one acre par- <br />cel of land located at the southwest corner of Pimlico Drive and <br />Brockton Drj.ve, described as Parcel A of Parcel Map 1873 (the <br />"Property"). <br /> <br /> B. The City has proposed to realign Pimlico Drive and make <br />other ancillary improvements as shown on Exhibit A. The realign- <br />ment requires the acquisition of a portion of the Property lying <br />along its southerly boundary. <br /> <br /> C. In conjunction with the realignment of Pimlico Drive, <br />the City plans to vacate the portion of Pimlico Drive adjacent to <br />the Property, to vacate an existing Public Service Easement <br />("PSE") burdening the northerly portion of the Property, and to <br />relocate all utilities within the existing Pimlico Drive and PSE <br />except for the reservation of a ten (10) foot gas line easement. <br />Upon completion of the realignment, the City will have as excess <br />property the portion of Pjmlico Drive adjacent to the property. <br />The City wishes to use such property to offset the cost of the <br />property required to be acquired for the realignment, and <br />Shepherd wishes to acquire said excess property. After this swap <br />of parcels, it is the intent of both parties to leave Shepherd <br /> <br />1 <br /> <br /> <br />
