CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 84-551 <br /> <br />APPROVING DEEDS FROM CITY TO HOPYARD PROFESSIONAL CENTER <br />AND DELTA PROPERTIES <br /> <br />WHEREAS, <br /> <br />City has entered into an agreement dated December 27, <br />1982 obligating it to convey certain property to Delta <br />Properties upon the realignment of the Hopyard-Owens <br />intersection and the vacation of a portion of Johnson <br />Drive, and the City and Delta Properties have agreed <br />that the proposed conveyance meets the requirements of <br />that agreement although the boundary of the parcel to be <br />conveyed has been modified; and <br /> <br />WHEREAS, <br /> <br />City has approved a stipulation for judgment with <br />respect to the condemnation of certain lands owned by <br />Hopyard Professional Center which requires the con- <br />veyance of certain property to Hopyard Professional Cen- <br />ter upon the vacation of a portion of Johnson Drive, and <br />the City and Hopyard Professinal Center have agreed that <br />the proposed conveyance meets the requirements of that <br />stipulation for judgment; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: The City hereby grants that certain parcel of land <br /> described in the attached Exhibit A and shown on Exhibit <br /> A-l, attached hereto and incorporated herein by this <br /> reference to Delta Properties, a California general <br /> partnership. <br /> <br />Section <br /> <br />2: The City hereby grants that certain parcel of land <br />described in the attached Exhibit B and shown on Exhibit <br />B-l, attached hereto and incorporated herein by this <br />reference, to Hopyard Professional Center, a general <br />partnership. <br /> <br />Section 3: Authorizes the Mayor to execute said grant deeds. <br /> <br />Section 4: Authorizes staff to do whatever necessary to effect <br /> the above conveyances. <br /> <br />Section 5: Directs staff to withhold conveyance of the above <br /> grant deeds until Delta Properties and Hopyard Profes- <br /> sional Center have agreed upon and finalized reciprocal <br /> easements for the joint use of the driveway serving both <br /> properties, as required by agreement and stipulation for <br /> judgment. <br /> <br /> <br />
