LEASE AGREEMENT <br /> <br /> THIS LEASE is made and entered into this day of <br />198~ by and between the CITY OF PLEASANTON, a municipal <br />corporation (hereinafter referred to as "the City") and CHRIS <br />BERATLIS E~]TERPRISES, a (hereinafter <br />referred to as "Lessee"). <br /> <br />WITNESSETH: <br /> <br /> WHEREAS, the City is the owner of an approximately twenty <br />(20) acre site shown on Exhibit "A", attached hereto and <br />incorporated herein by this reference (the "premises"), which it <br />has leased for several years to Lessee, and Lessee wishes to <br />continue to lease said property; and <br /> <br /> WHEREAS, Lessee is knowledgeable of the current condition of <br />said property, including its potential for flooding, and is also <br />knowledgeable of the City's plans to make the premises available <br />for construction of a senior citizen complex in the near future; <br />and <br /> <br /> WHEREAS, the City wishes to have said property maintained and <br />utilized for agricultural purposes in a manner beneficial to the <br />City both through its proper maintenance at no cost to the City <br />and for its nominal fair rental value; and <br /> <br /> WHEREAS, the City has determined that it is in the best <br />interests of the City to lease the premises at the fair market <br />rental value to Lessee without competitive bidding due to the <br />nominal value of the lease, the past record of acceptable <br />maintenance of the premises by the Lessee, and the uncertain <br />tenure of the lease; <br /> <br /> NOW, THEREFORE, in consideration of the rent hereinafter <br />specified to be paid by Lessee and the covenants and agreements <br />hereinafter contained, the City and Lessee agree as follows: <br /> <br /> 1. Leasehold. The City hereby leases to Lessee those <br />premises shown on Exhibit "A". <br /> <br /> 2. Term. The term of this lease shall be for a period of <br />one year, beginning on October 1, 1984 and ending on <br />September 30, 1985. <br /> <br /> 3. Rent. Lessee agrees to pay to the City as rent for the <br />premises the sum of FOUR HUNDRED DOLLARS ($400.00) for the full <br />term hereof, all due and payable upon the execution of this <br />lease. <br /> <br /> 4. Use of Premises. Lessee agrees. to use the premises for <br />agricultural and/or grazing purposes and for no other purpose <br />whatsoever without the written consent of the City Manager being <br />first obtained. <br /> <br />- 1 - <br /> <br /> <br />
