If t[~e lowest acceptable construction bid exceeds <br />the budgeted cost of construction by more than <br />15%, and CITY elects not to approve the excess <br />or to reject all bids and either rebid or nego- <br />tiate, then CONSULTA~T shall, upon request of <br />the CITY, revise the drawings and specifications <br />~thout additional charge so as to obtain an <br />acceptable bid within 15% of the fixed budget <br />limit of construction. CITY will cooperate w~th <br />CONSULTANT in order to effect such reduction. <br />CONSULTANT shall have the option of including <br />alternate bid items, additive items or deduct <br />items acceptable to CITY so as to permit flex- <br />ibility in accepting a bid within the budgeted <br />construction limit. <br /> <br />If upon completion of the work described above, <br />and the award of construction contract is delayed <br />for more than three (3) months after CONSULTANT'S <br />submission of the revised working drawings and <br />specifications and estimates, CITY shall have the <br /> <br />option to: <br />a Increase <br />b Authorize <br /> <br />the construction budget; or <br /> <br /> CONSULTANT to furnish addi- <br /> <br />tional alternate bid items, CONSULTANT'S <br />compensation for which shall be on an <br />Extra Work basis; or <br /> <br />Authorize CONSULTANT to redesign to <br />bring PROJECT within the budget, CON- <br />SULTANT'S compensation for which shall <br />be on an Extra Work basis; or <br /> <br />Cancel agreement as per Section VII. <br /> <br />Both options (b) and (c) above shall be consi- <br />dered Extra Work and paid for on a Time-and- <br />!faterials basis in accordance with section I.D. <br /> <br />-8- <br /> <br /> <br />
