EIGHTH AMENDMENT TO AGREEMENT <br /> <br /> This amendment made and entered into this day of , <br />1984, by and between the CITY OF PLEASANTON (hereinafter referred to as <br />"CITY" or "OWNER") and KENNEDY/JENKS ENGINEERS, INC., formerly Kennedy <br />Engineers, Inc., a California corporation (hereinafter referred to as <br />"ENGINEER"); <br /> <br />WITNESSETH <br /> <br /> WHEREAS, CITY AND ENGINEER entered into an Agreement dated <br />7 January 1974 for engineering services related to the construction of <br />an interceptor sewer line from CITY's Sunol sewage treatment plant to <br />the Valley Community Services District (now known as the Dublin- <br />San Ramon Services District) sewage treatment plant; and <br /> <br /> WHEREAS, the parties have previously entered into Amendments to <br />the 7 January 1974 Agreement in order to comply with current or chang- <br />ing Federal Regulations (First Amendment dated 9 February 1976; Second <br />Amendment dated 11 April 1977; Third Amendment dated 15 September 1977; <br />Fourth Amendment dated 27 November 1979; Fifth Amendment dated <br />10 November 1981; Sixth Amendment dated 23 November 1982; and the <br />Seventh Amendment dated 23 November 1982; and <br /> <br /> WHEREAS, billings for work performed during 1981, 1982 and 1983 <br />were based on provisional overhead rates that have now been suspended <br />by audited rates; <br /> <br /> NOW, THEREFORE, in consideration of the terms, promises, <br />covenants, and conditions set forth herein, the parties hereto agree to <br />amend Amendments No. 1, 2, 3, 4, 5, 6, and 7 as follows: <br /> <br />ENGINEER'S OVERHEAD RATE MODIFICATION: <br /> <br /> Engineer's provisional overhead rates referred to in Contract and <br />Amendments No. 1, 2, 3, 4, 5, 6, and 7, as applicable, shall be <br />adjusted as follows: <br /> <br />For all work performed in 1981: <br /> <br />K/J JOB NO. <br /> <br />O.H. RATE CHARGED <br /> <br />AUDITED O.H. RATE <br /> <br />8051 and 1032 146% 148-7% <br />1112 144.7% 148.7% <br /> <br />For all work performed in 1982: <br /> <br />K/J JOB NO. <br /> <br />O.H. RATE CHARGED <br /> <br />AUDITED O.H. RATE <br /> <br />1032 146% 168.9% <br />1112 144.7% 168.9% <br /> <br /> <br />
