CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 84-480 <br /> <br />ACCEPTANCE OF QUITCLAIM DEED FOR SUBTERRANEAN WATER AND <br />QUITCLAIM OF CITY RIGHTS OF SURFACE ENTRY FOR TRACT <br />5248, MOHR PARK, RHODES CORPORATION dba SHEA HOMES <br /> <br />WHEREAS, <br /> <br />the City is in receipt of a Quitclaim Deed from Rhodes <br />Corporation, dba Shea Homes, to the City of Pleasanton <br />for subterranean waters, without rights of surface en- <br />try, which is given in exchange for a Quitclaim Deed <br />from the City of Pleasanton to Rhodes Corporation for <br />surface entry rights and easements, if any, related to <br />the extraction of water; and <br /> <br />WHEREAS, <br /> <br />at its meeting of October 2, 1984, the City Council <br />received a report from the Director of Public Works and <br />Utilities indicating that the exchange of these deeds is <br />in the public interest; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Authorizes the mayor to execute the Quitclaim Deed <br /> from the City of Pleasanton to Rhodes Corporation, a <br /> Nevada corporation, dba Shea Homes, for surface entry <br /> rights and easements, if any, related to the extraction <br /> of water in Tract 5248, Mohr Park. <br /> <br />Section <br /> <br />2: Accepts a Quitclaim Deed from Rhodes Corporation, a <br />Nevada corporation, dba Shea Homes, to the City of <br />Pleasanton for subterranean waters, without rights of <br />surface entry for Tract 5248, Mohr Park, and the ap- <br />propriate city officers are instructed to take whatever <br />action necessary to implement said acceptance. <br /> <br />Section 3: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED OCTOBER 2, 1984 BY THE FOLLOWING VOTE: <br /> <br /> <br />
