WATER FACILITY AND REIMBURSEMENT AGREEMENT <br /> <br />Tract No. 5189, Grey Eagle Estates, Pleasanton <br /> Alameda County, California <br /> <br />THIS AGREEMENT made and entered at Pleasanton, California this <br /> <br />day of .......... , 1984, by and between: <br /> <br />Grey Eagle, a Joint Venture <br />147 Bernal Avenue <br />Pleasanton, CA 94566 <br /> <br />(hereinafter referred to as "Subdivider") and the City of Pleasanton, <br /> <br />a general law city, located in Alameda County~ California, acting <br /> <br />through the City Manager and the City Clerk (hereinafter referred to <br /> <br />as "City"). <br /> <br /> WHEREAS, Subdivider has a tentative map for said tract, lying <br />within the boundaries of the City; duly approved by the Planning <br />Commission or the City Council; and <br /> <br /> WHEREAS, all or a portion of the area of the tentative map has <br />been presented as a final map, a copy of said map is on file in the <br />office of the City Engineer, and by reference is included in this <br />agreement for all purposes as if attached hereto; and <br /> <br /> WHEREAS, pursuant to Government Code Section 66485, the City <br />has authority to require that improvements installed by the Subdivider <br />for the benefit of a subdivision shall contain supplemental size for <br />the benefit of property not within the subdivision; and <br /> <br /> WHEREAS, the logical expansion of the water system in this <br />area requires the construction of a water reservoir to serve this <br />subdivision and the surrounding area, as described in more detail <br />in Camp, Dresser & McKee, Inc. studies of January, 1983; March, 1984; <br />and May, 1984; and <br /> <br /> WHEREAS, this Agreement is intended to provide for the funding <br />and reimbursement for the reservoir; and <br /> <br /> WHEREAS, it is the intent of the parties that <br />be entered into with the subdividers of adjacent R <br />property; and <br /> <br />a similar agreement <br />and W Ranch <br /> <br /> WHEREAS, the Camp, Dresser & McKee studies show a need for a <br />1.8 million gallon reservoir of which 1 million Gallons is needed by <br />existing City water customers, and .8 million gallons is the projected <br />requirement for new developments in the study area; and <br /> <br /> <br />
