That the granting of the variance will not be <br />detrimental to the public health, safety, or wel- <br />fare, or materially injurious to properties or im- <br />provements in the vicinity; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section <br /> <br />1: Approves the appeal of Morgan Construction Company to <br />the decision of the Board of Adjustment and grants the <br />variance from the requirements of the Code to allow the <br />establishment of a subdivision sales office for the <br />Brookfield Place Townhomes located in the area west of <br />1-680 and south of West Las Positas Boulevard which <br />would be less than 200 feet from an existing occupied <br />dwelling unit outside of the subdivision, subject to the <br />following conditions: <br /> <br />That the variance is approved solely to allow the <br />establishment of a subdivision sales office in the <br />two garages shown on the site plan, Exhibit A, dated <br />9/5/84, on file with the Planning Department. <br /> <br />That staff is instructed to approve a minor revision <br />to case UP-84-34, the conditional use permit govern- <br />ing the model home complex for the Brookfield Place <br />development, which relocates the subdivision sales <br />office as approved in that use permit to the garages <br />applied for under case V-84-15. <br /> <br />Section: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED SEPTEMBER 11, 1984 BY THE FOLLOWING VOTE: <br /> <br />AYES: <br /> <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />ATTEST: <br /> <br />Councilmembers - Brandes, Butler, Mohr, <br />Mercer <br />None <br /> <br /> K H R ME CER, MAYOR <br /> <br />By Doris George, Deputy City Clerk <br /> <br />Wood and Mayor <br /> <br />A~P~OVED AS TO FORM: <br /> O. <br />Peter D.
