VAI,LEY AVENUE EXTENSION AGREEMENT <br /> <br /> TUIS AGREE!.IE[JT is entered into this llth day of September, <br /> <br />1984, by anf] between the CITY OF PLEASANTON, a municipal corporation, <br />(hereinafter referred to as "City") and R. J. and CAROL E. MOLINARO, <br />husband and wife, and Ao and SHIRLEY ~CCHtANO, husband and wife, <br />(hereinafter referred to as "Landowner"). <br /> <br /> RECITALS <br /> <br /> A. Landowner owns a 4.03 acre parcel at 3110 Busch Road <br />(A.P.N. 946-1250-38) (hereafter "the Property"). <br /> <br /> B. Lando~er has applied to City for approval of a 2,816 <br />square foot addition to an office building at the Property on <br />behalf of Pleasanton Garbage Service, Inc. (Z-84-232). <br /> <br /> C. City has applied to the California Public Utilities <br />Commission for approval of the Valley Avenue Extension Project <br />(P.U.C. Application No. 83-12-39). <br /> <br /> D. The Valley Avenue Extension Project consists of three <br />public street crossings of the existing railroad tracks including <br />the extension of Valley Avenue to connect with Stanley Boulevard, <br />and upgrading the Busch Road connection to Valley Avenue to become <br />a public rather than private crossing (see Exhibit A, attached). <br /> <br /> E. %he Property is within the area which will specially benefit <br />from the proposed Valley Avenue Extension Project and the effects <br />of Z--84-232 will be mitigated by completion of the Valley Avenue <br />Extension Fv:ljcct. <br /> <br /> NOW, THEiIEFORE, in consideration of the faithful performance <br /> <br />of the terms, conditions, covenants and promises set forth herein, <br />the parties hereto agree as follows: <br /> <br />-1- <br /> <br /> <br />
