CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 84-444 RESOLUTION VACATING PORTIONS OF PIMLICO DRIVE WHEREAS, On August 28, 1984, the City Council received a staff report recommending the vacation of portions of Pimlico Drive and the public service easement adjacent thereto, more particularly described in plats and accompanying legal descriptions labeled Exhibit "A" and Exhibit "B", attached hereto and incorporated herein by this reference; and WHEREAS, the proposed relocation of Pimlico Drive and the public service easement is consistent with the goals and poli- cies of the General Plan; and WHEREAS, the superseded portion of Pimlico Drive is no longer necessary for present or prospective public use due to relocation of the street; and WHEREAS, access shall not be cut off to any person's property which, prior to relocation, adjoined the street being vacated; and WHEREAS, there is in place public utility facilities which are in use, and public convenience and necessity require the reservation of easements for these utility facilities; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Pursuant to Chapter 4 of the Streets and Highways Code and based upon the findings above establishing the relocation of Pimlico Drive in a manner meeting the re- quirements of Section 8330 of the Streets and Highways Code, those portions of Pimlico Drive described in Ex- hibit "A" are hereby vacated. Section 2: Pursuant to Chapter 4 of the Streets and Highways Code and based upon the findings above establishing the necessity to vacate the public service easement in a manner meeting the requirements of Section 8333(c) of the Streets and Highways Code, those portions of the public service easement described in Exhibit "B" are hereby vacated. - 1 -
