CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 84-443 APPROVING MINOR MODIFICATION TO PUD-82-13-2M (DEER OAKS) ALLOWING REMOVAL OF AN OAK TREE WHEREAS, Condition No. 14 of PUD-82-13 governing the Deer Oaks development requires that the large oak tree near the former stable on the site be repaired and maintained in a healthy condition at all times; and WHEREAS, due to construction of a roadway and a possible pre- existing diseased condition, it is now impossible to save this tree; and WHEREAS, Condition Number 68 of the PUD requires that the emer- gency access road between Deer Oaks Drive and the end of Twelve Oaks Drive be surfaced to the satisfaction of the Fire Marshal and the Director of Public Works; and WHEREAS, the developers of Deer Oaks have requested a modifica- tion of case PUD-82-13 to allow removal of the oak tree and construction of the emergency access road without a paved surface; and WHEREAS, at its meeting of August 22, 1984, the Planning Commis- sion considered the above requests and recommended ap- proval under the circumstances; WHEREAS, a public hearing was held before the City Council on August 28, 1984 to consider the Commission recommendation; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Approves the modification of PUD-82-13 subject to the following conditions: That condition number 14 of case PUD-82-13 is no longer of any relevance or effect and is therefore deleted. That the oak tree be completely removed as soon as possible and that the island in Deer Oaks Drive in which it is located be reconstructed as a raised planter and landscaped subject to staff approval and that an irrigation line be provided to the planter. That three 24 inch box oak trees be planted on the Deer Oaks property in a location acceptable to the staff to replace the damaged oak tree.
