RiGHT-OF-ENTRY AGREEMENT <br /> <br /> THIS AGREEMENT is made this day of July, 1984, by <br /> <br /> and between WILLIAM G. SHEPHERD and JOYCE Y. SHEPHERD ("Shepherd") <br /> and the CITY OF PLEASANTON, a municipal corporation ("City"). <br /> <br /> RECITALS <br /> <br /> A. Shepherd is the owner of an approximately one acre parcel <br />of land located at the southwest corner of Pimlico Drive and <br />Brockton Drive, and described as Parcel A of Parcel Map 1873 (the <br />"Property"). <br /> <br /> B. Shepherd and the City are presently negotiating for the <br />acquisition of a portion of the Property necessary for the realign- <br />ment gf Pimlico Drive by the City. <br /> <br /> C. Pending completion of such negotiations, the City, <br />together with its agents, representatives and contractors,wishes <br />to enter upon the Property for the purpose of installing improvements <br />pertaining to the realignment and construction of Pimlico Drive. <br /> <br /> D. Shepherd is willing to give to the City an interim <br />right-of-entry to the Property pending agreement being reached 'by <br />Shepherd and City on acquisition of the necessary right-of-way in <br /> <br />order to allow the roadway to be timely constructed. <br /> NOW, THEREFORE, the parties agree as follows: <br /> <br /> 1. Shepherd hereby gives to the City, and its agents, <br />representatives and contractors, a license to enter upon the <br />Property for the purposes of placement of fill, roadway improvements, <br />curbs, gutters, installation of underground electrical ducts, storm <br />drains, and other utilities, including service laterals, all as <br /> <br /> <br />
