CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 84-420 <br /> <br />RESOLUTION APPROVING AMENDMENT TO PUC APPLICATION <br />FOR VALLEY AVENUE EXTENSION TO SUBSTITUTE GRADE <br />SEPARATION FOR AT-GRADE PROPOSAL <br /> <br />WHEREAS, <br /> <br />in November, 1983, Council authorized an application <br />to the Public Utilities Commission for an at-grade <br />crossing by Valley Avenue of Southern Pacific and <br />Union Pacific tracks; and <br /> <br />~HEREAS, <br /> <br />on July 10, 1984, Council authorized modifications <br />to the PUC application in response to PUC staff <br />concerns; and <br /> <br />WHEREAS, <br /> <br />as a result of continuing negotiations with the rail- <br />roads, a significant breakthrough has occurred in the <br />form of staff level conceptual agreement as to four <br />major elements which should form the basis for a <br />memorandum of understanding; and <br /> <br />WHEREAS, the City Attorney presented his report (SR 84:405) <br /> Council describing in detail the four major issues; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />to <br /> <br />Section 1: Council authorizes an amendment to the PUC applica- <br /> tion to request a single bridge structure grade separation <br /> subject to City, Southern Pacific and Union Pacific <br /> signing a memorandum of understanding. <br /> <br />Section 2: Council authorizes staff to negotiate a memorandum <br /> of understanding with the railroads incorporating the <br /> four elements set forth in the above-referenced staff <br /> report and bring the memorandum of understanding to the <br /> City Council as soon as possible. <br /> <br />Section 3: Approves the contract with DeLeuw, Cather and <br /> Company for design and construction services for the <br /> Proposed Valley Avenue Railroad Grade Separation at <br /> the Union Pacific and Southern Pacific railroads, a <br /> copy of which is attached hereto and incorporated <br /> herein by this reference. <br /> <br />Section 4: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> <br />
