Alexander Kanarsky said his older son has taken piano lessons for more than two years, said it is <br /> impossible to fully utilize all parking when taking lessons due to the nature of the business occurring <br /> after school and in the evening. He felt the area was very quiet, not dangerous for children, and was <br /> fully supportive of the studio. He also felt the location was more convenient than being located <br /> downtown and is very much like other uses in the business park. <br /> Tony McCants, Principle, Keron Wrights Civil Engineer at 1233 Quarry Lane, which is across the <br /> street from the school, said he has been at the park almost 10 years, they have difficulties with the <br /> school parking in their parking lot, have difficulties with them parking up against the driveways, they <br /> park in the red zone, the bus loop gets convoluted, and the school is a constant problem. They <br /> mitigate this by the fact that they were there first. His staff is cautious but he has almost gotten hit <br /> several times while looking at parents running across the street with children which are not safe. He <br /> also said the business is listed as a trade school, which is a reach to a music school. When Mr. <br /> Studzinski bought the property, it was subject to the CC &R's which were negotiated with the City <br /> and if approved under the zoning, it takes approval from the Architectural Review Committee of the <br /> Business Park which has not been identified. Parking on the street is prohibited in the CC &R's and <br /> he thought Quarry Lane was signed for no parking at one time, but the signs are gone now. He said <br /> the staff report suggests off -site parking is appropriate, but there are no sidewalks, so anyone <br /> walking must use streets and driveways. Lastly, he said the problems they are having with <br /> conversions of business parks is sewer allocation and capacity. The trade school has been allowed <br /> to fit into the zoning, but the building is sewered for office, at .05 and it is allocated in the CC &R's <br /> for the condominium creation. Therefore, this is a different rate than a school, which is 15 gallons <br /> per day per student. He did not feel City staff has completely compiled all of the facts in their report, <br /> and he felt the trade school designation sticks out as the most liberal interpretation. He understands <br /> the support for children and schools, but in the business park, it can be problematic and he asked <br /> the City to protect his business, employees and interests. <br /> Mayor Hosterman closed the public hearing. <br /> Councilmember Sullivan said Mr. Studzinski indicated he was having difficulty leasing out his two <br /> front spaces because of the school. Mr. Studzinski said he has had two realtors who both <br /> mentioned it but will not come right out and say it. He had an engineering company who went to <br /> Livermore because they did not feel the school was appropriate, but they would not put this in <br /> writing. <br /> Councilmember McGovern questioned whether or not hours would be changed during the summer <br /> when children are home. Mr. Dolan said their proposal does not address any changes in time. She <br /> questioned whether operational times was clearly stated in documents. Mr. Dolan said there is no <br /> condition or limitation during the summer which would address this. Councilmember McGovern said <br /> all of the information suggests that the business starts after school is let out; however, hours of <br /> operation are listed starting at 10:00 a.m. This means that the school could start at 10:00 a.m. in the <br /> summer and this is when the parking conditions could be problematic. Mr. Dolan agreed this could <br /> occur as conditioned. <br /> Councilmember McGovern questioned if staff would support a condition that requires the school to <br /> start in the summer at 3:00 p.m. or 3:30 p.m. Mr. Dolan said staff did not consider this, and felt the <br /> issue was addressed through the limitation of 3 instructors until 4:30 p.m. They can have 3 <br /> instructors starting at 10:00 a.m. year round and would very likely have more customers in the <br /> summer earlier in the day, but they would never be allowed more than 3 instructors. <br /> City Council Minutes Page 13 of 20 April 21, 2009 <br />
