Councilmember Sullivan confirmed with Mr. Studzinski that he has a machine shop and makes precision parts for industry. They have computerized milling machines and lathes and have been there for 20 years. He bought the building 8 years ago and wants to stay there. He has 14 employees now, but during busy times he has had 28 employees comprising of local machinists and support staff. He noted TMJ and Pleasanton Tools are both machine shops across the street, Hilphoenix Company, Peridot is on the corner that has a huge building which is assembly, machinists and high tech. They have STL Labs on the other corner that do chemical groundwater testing, an electronics company across the street from them. He said there is a much greater percentage of industry in the park than uses like a school, and he said the Super Gen fire a week ago had toxic fumes. Rimma Radayeva, Applicant, said in February 2006, she looked for a place to open her business, she had no idea that the business would grow so fast, and she was able to buy 5 new grand pianos and thanked teachers who are credentialed. She said she came from the Ukraine 7 years ago and said music is not taught in public schools and her private lessons train children to become professional musicians and no one else offers such an education, which is supported by local parents. They currently operate with 5 teachers who work part-time and she emphasized that her type of school is needed close to residential areas. She read the appeal points and said she discussed how children are brought to her classes by hand, they require parents sign children in and out, agreed safety is important and said their classes normally start at 3:00 p.m. and is amenable to having only 3 teachers hold class up to 4:30 p.m. She said most children come at 4:30 through 8:00 p.m. and there are no trucks that come and go at that time. She said industrial uses close to her shop in the business park include a cabinet shop, a roofing company, and a sound recording studio. She did not agree there were parking problems and when parents are asked to re- park their cars, they do so. She also has a sign on her door that asks parents to park in designated areas which has been approved by the City and every parent must agree to it and sign it. Teachers are also asked not to park in front of the studio and have signed the document. Regarding appeal item 4, she said this would inhibit her ability to lease out her front spaces. She said at the time she bought her property, she knew Jerry Pentin had the recording studio and he has not objected to her use. The cabinet shop purchased their space and do not object to her business. She said Three C also purchased his property and knew of her business and did not object to it. Regarding loitering and rock throwing, she said many parents do not even walk by the appellant's property, and she asked that the council not consider Mr. Studzinski's personal opinion about the matter more than the neighbors and parents who also have their opinions. Paulie Pan said her 8 year old son has taken piano lessons for two years and spoke in support of the application to extend the permit to 5 instructors. She noted Quarry Lane Business Park has a preschool, jazz and dance, a piano studio, kung fu business, a party palace. Cathey Young said her 6 year old daughter takes lessons from Ms. Radayeva. She noted that within walking distance of the studio is Quarry Lane School which provides infant care, preschool and kindergarten activities, as well as after school care for elementary students, and summer programs. Also, there is a tap and dance studio, another music studio, a gymnastics studio, a cheerleading studio, an after school learning center and a jump house for children's parties.
