RESOLUTION NO. 09- <br />ATTACHMENT 3 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, <br />APPROVING THE AFFORDABLE HOUSING AGREEMENT BETWEEN THE <br />CITY OF PLEASANTON AND CIVIC SQUARE, LLC, REGARDING THE CIVIC <br />SQUARE APARTMENTS EXPANSION PROJECT <br />WHEREAS, Ordinance No. 1488 of the City of Pleasanton sets forth a <br />Lower Income Housing Fee requirement to support an affordable housing program (at <br />Chapter 17.40 of the Pleasanton Municipal Code) which authorizes the City to enter into <br />regulatory agreements with developers to exempt projects from the lower- income housing <br />fee if the projects provide fifteen percent (15 of its residential units at affordable levels; <br />and <br />WHEREAS, Civic Square, LLC has made an application to the City for an <br />Affordable Housing Agreement for the Civic Square Apartments expansion project; and <br />WHEREAS, the Civic Square Apartments expansion project is categorically <br />exempt from the requirements of the California Environmental Quality Act (CEQA), <br />Section 15332, In -Fill Development Projects, Article 19; and <br />WHEREAS, a duly noticed public hearing concerning the Affordable Housing <br />Agreement was held by the City Council on May 19, 2009; and <br />WHEREAS, the City Council considered all the information presented at the <br />public hearing by Civic Square, LLC, staff, and members of the public regarding the <br />terms of the Affordable Housing Agreement. <br />NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br />PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER THE <br />FOLLOWING: <br />SECTION 1. Finds that the proposed Affordable Housing Agreement between the <br />City of Pleasanton and Civic Square, LLC is consistent with the City's General Plan and <br />the objectives of the Lower Income Housing Fee ordinance and the City's affordable <br />housing policies. <br />SECTION 2. Approves the Affordable Housing Agreement between the City of <br />Pleasanton and Civic Square, LLC, a copy of which is attached hereto as Exhibit C and <br />incorporated herein by this reference; and authorizes the City Manager to execute the <br />Affordable Housing Agreement. <br />SECTION 3. This resolution shall become effective immediately upon its <br />passage and adoption. <br />1 <br />
