ORDINANCE NO. <br />ATTACHMENT 1 <br />AN ORDINANCE APPROVING THE APPLICATION OF BRADDOCK AND <br />LOGAN FOR A PUD MAJOR MODIFICATION, AS FILED UNDER <br />CASE PUD- 84- 21 -04M <br />WHEREAS, Braddock and Logan has applied for a major modification to an <br />approved Planned Unit Development (PUD) development plan to add 12 new units in <br />three buildings at the Civic Square Apartments located at 4800 Bernal Avenue; and <br />WHEREAS, zoning for the property is PUD -HDR (Planned Unit Development <br />High Density Residential District; and <br />WHEREAS, the proposed project is categorically exempt from the requirements <br />of the California Environmental Quality Act (CEQA), Section 15332, In -Fill Development <br />Projects, Article 19; and <br />WHEREAS, the City Council received the Planning Commission's positive <br />recommendations for approval of the PUD major modification for the subject site; and <br />WHEREAS, the City Council finds that the PUD major modification and <br />development plan are consistent with the General Plan policies and the purposes of <br />the PUD ordinance of the City of Pleasanton. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />HEREBY ORDAIN AS FOLLOWS: <br />SECTION 1. Approves Case PUD- 84- 21 -04M, the application of Braddock and <br />Logan for a major modification to an approved Planned Unit Development (PUD) <br />development plan to add 12 new units in three buildings at the Civic Square Apartments <br />located at 4800 Bernal Avenue, subject to the conditions shown on Exhibit A, attached <br />hereto and incorporated herein by this reference. <br />SECTION 2. A summary of this ordinance shall be published once within <br />fifteen (15) days after its adoption in "The Valley Times," a newspaper of general <br />circulation published in the City of Pleasanton, and the complete ordinance shall be <br />posted for fifteen (15) days in the City Clerk's office within fifteen (15) days after its <br />adoption. <br />SECTION 3. This ordinance shall be effective thirty (30) days after its passage <br />and adoption. <br />ADOPTED at a regular meeting of the City Council of the City of Pleasanton on <br />May 19, 2009. <br />
