THE CITY OF <br />i <br />`m rn 1111 <br />pLE ASANTONC <br />CITY COUNCIL AGENDA REPORT <br />May 19, 2009 <br />Community Development <br />Planning Division <br />TITLE: PUD- 84- 21 -04M, BRADDOCK AND LOGAN CONSIDER AN <br />APPLICATION FOR A PUD MAJOR MODIFICATION TO ADD 12 NEW <br />UNITS IN THREE BUILDINGS AT THE CIVIC SQUARE APARTMENTS <br />LOCATED AT 4800 BERNAL AVENUE AND A DRAFT AFFORDABLE <br />HOUSING AGREEMENT <br />SUMMARY <br />This is an application by Civic Square, L.L.C. and Andy Byde (Braddock and Logan <br />Services, Inc.) for a PUD major modification to add 12 new units in three buildings at the <br />Civic Square Apartments located at 4800 Bernal Avenue, and for an affordable housing <br />agreement for the entire development. The proposed project provides affordable multi- <br />family rental housing in close proximity to the downtown, public transit, and schools; is <br />designed in a manner compatible with the site and nearby buildings; and will achieve a <br />minimum 75 Leed green building points. <br />HOUSING COMMISSION ACTION <br />On February 19, 2009, the Housing Commission, on a 5 -0 vote, approved the draft <br />Affordable Housing Agreement. <br />PLANNING COMMISSION ACTION <br />On March 25, 2009, the Planning Commission, on a 4 -0 vote, approved the proposed <br />modification subject to the conditions of approval. <br />RECOMMENDATION <br />Staff recommends the City Council make the PUD development plan findings in <br />Attachment 4, introduce the ordinance approving Case PUD- 84- 21 -04M subject to the <br />draft conditions of approval in Attachment 1, and adopt the draft resolution approving <br />the Affordable Housing Agreement in Attachment 3 and authorizing the City Manager to <br />execute the Agreement. <br />FINANCIAL STATEMENT <br />The applicant will pay all required building permit and development fees including the <br />residential school impact and regional traffic impact fees; will pay property taxes; will <br />provide 12 rental units affordable to moderate- and low- income households; and will <br />administer the affordable housing agreement with the City. <br />12 <br />
