Uouglass <br />F, Anderson <br /> <br /> (b) At any time Kaiser and/or Rhodes-Jamieson <br />may terminate such use by the Users or restrict or <br />limit the use (as, for example, by limiting hours of <br />use, or number of trucks) when, in the reasonable <br />business judgment of Kaiser and/or Rhodes-Jamieson, <br />such use interferes with the normal business operations <br />of Kaiser and/or Rhodes-Jamieson. <br /> (c) Kaiser and/or Rhodes-Jamieson shall have the <br />full right and power to police use of the Road by all <br />Users, including, without limitation, the right to <br />establish and maintain reasonable and safe speed <br />limits and rules and regulations for safe operation <br />and prohibiting or restricting the transport of <br />hazardous, explosive, or infl~amatory material upon <br />the Road, and the right to require satisfactory <br />indemnity and hold harmless agreements from Users or <br />some of them. If any User violates such standards, <br />rules or regulations, Kaiser and/or Rhodes-Jamieson <br />may permanently deny future use of the Road to such <br />User. <br /> <br /> (d) Kaiser and Rhodes-Jamieson may charge and <br />collect from each such User a reasonable user fee, <br />in order to provide funds for the maintenance of the <br />Road made necessary by the additional wear and tear <br />generated as a result of the use by Users. <br /> <br /> (e) It is the intent of this paragraph 13 to <br />provide the said license for the Users in order to <br />assist the City and the Valley Business Park owners, <br />tenants and customers (1) until an alternate route <br />becomes available for truck traffic or (2) until the <br />City has had a reasonable opportunity to arrange for <br />such an alternate route, five years being considered <br />reae~ouc~b]t!. Accordingly, (i) the license shall be <br />car]troll]ca jH~d he~'mLndted and no further use of the <br />Road shall be permitted by Users, or any of them, <br />promptly upon completion of IsabeltAvenue or Isabel <br /> <br /> <br />
