RESOLUTION NO. 09-279 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, APPROVING A NEGATIVE DECLARATION FOR THE APPLICATION OF DUTRA TRUST, AS FILED UNDER CASE PUD-77 WHEREAS, at its meeting of April 21, 2009, the City Council received a proposed Negative Declaration for the application of Dutra Trust for Planned Unit Development (PUD) development plan approval to subdivide aten-acre site located at 1053 Happy Valley Road into five single-family residential lots and one open space parcel; and WHEREAS, the City Council received and reviewed the Initial Study, dated November 7, 2008, and received the recommendations of the staff and Planning Commission; and WHEREAS, a duly noticed public hearing was held on April 21, 2009, at which time the public was given the opportunity to comment on the environmental impacts of the proposed project; and WHEREAS, the City Council has reviewed the potential impacts in accordance with the applicable state and local guidelines governing the preparation of Negative Declarations and Environmental Impact Reports; and WHEREAS, the City Council finds that the proposed project would not have any significant adverse effects on the environment. NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER THE FOLLOWING: SECTION 1. Approves the Negative Declaration for the application of Dutra Trust for Planned Unit Development (PUD) development plan approval to subdivide aten-acre site located at 1053 Happy Valley Road into five single-family residential lots and one open space parcel. SECTION 2. The City staff is directed to cause a Notice of Determination to be filed pursuant to Section 5.4(g) of Resolution No. 77-66. SECTION 3. This resolution shall become effective immediately upon its passage and adoption. PASSED, APPROVED, AND ADOPTED by the City Council of the City of Pleasanton at a regular meeting held on April 21, 2009. 1
