any and all claims for injury or damage of whatever type brought by Or on behalf of any third party, including, but not limited to, ACTv_B/AC.A2's officers, employees, and agents, arising from or con- nected witch any acts Or omissions in the performance of this amended agreement by ACTv-B/AC-~P except from any such claim arising solely out of acts or omissions attributable to the ACT~_R/ACAP member or its officers, employees, or agents. IV. FISCAL CONTROL A. Depository~ Controller. Pursuant to Section 6505.5 of the California Government Code, the Auditor/Controller and the Treasurer of the County of Alameda are hereby designated Auditor/Controller and Treasurer, respectively, of ACTEB/ACAP and they shall have all of the powers and duties specified in Section 6505.5 including but not limited C1) The Treasurer shall receive and receipt for all said funds of ACTEB/ACA9 and place it in the Treasury of the County of Alameda to T-he credit of ACTEB/ACAP; (2) The Treasurer shall be responsible upon his official bond for safe-keeping and disbursement of all funds of ACTEB/ACAP so held by him; (3) The Treasurer shall pay, when due, out cf said funds of ACTIB/AC.A? so held by him, all sums due from ACTEB/ACAP funds, only upon warrants of or checks issued by the Auditor/Controller: (4) The Treasurer shall verify and report in writing on the first day of July, October, January, and April of each year to AGTEB/ACA_m and to t/-.e signatories to this agreeme~'e^, the amount of said funds he holds for ACTEB/ACA~, T.he amount of receipts since his last report, .and the amount paid cut since his last report. (5) Pursuant to Section 6505 of ~he California Government Code, the Auditor/Con=roller shall contract wi~h a certified public accountant to make an annual audit of the accounts and records of ACTE~/ACA_~, copies of which a~dit shall be distributed to G~e County and Cities. (6) Pursuant to Section 6505.5 of the California Govern- ment Code, the Board of Supervisors of T-he Court ty of Alameda shall determine charges to be made against ACTE3/ACA2 for services cf the Treasurer and the Auditcr/Ccntrol!er. B. Records and Reports. ACTEB/AC~3 shall esta~!ish and rain such -~unds and accounts as may be required by good acccuntlng practice or by law.
