CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 84-364 <br /> <br />RELEASE OF PRE-ANNEXATIOI] AGREEr~NT OBLIGATIONS <br />FROM 3827 SARATOGA WAY, PLEASANTON <br /> <br />WHEREAS, <br /> <br />City and Sonne mistakenly recorded a pre-annexation <br />and provision of water facilities and services <br />agreement against the property commonly known as <br />3827 Saratoga Way in Pleasanton; and <br /> <br />WHEREAS , <br /> <br />the pre-annexation and provision of water facilities <br />and services agreement has subsequently been properly <br />recorded against the property commonly known as 510 <br />Happy Valley Road in accordance with the desires of <br />the Sonnes and City; and <br /> <br />WHEREAS, City and Sonne wish to rectify the above-described <br /> mistake; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: The property commonly known as 3827 Saratoga Way <br /> (more particularly described in Exhibit A, attached <br /> hereto and incorporated herein by this reference) is <br /> hereby released from any and all obligations contained <br /> in the agreement entered into by the City of Pleasanton <br /> and James L. and Elaine J. Sonne, entitled "Pre-Annexa- <br /> tion and Provision of Water Facilities and Services <br /> Agreement," dated February 14, 1984, a copy of which <br /> is attached as Exhibit B and incorporated herein by <br /> this reference. <br /> <br />Section 2: The City Clerk is directed to cause this resolution <br /> to be recorded with the Recorder of Alameda County. <br /> <br />Section 3: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED JULY 24, 1984 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - Brandes, Butler, Mohr, Wood and <br /> Mayor Mercer ~~ <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> <br />
