Fire Service: The site is located in the Fire Hazard area. As a result, the proposed new <br />homes must be equipped with fire sprinklers and must have a Class "A" roof. <br />Establishment of an Association <br />Staff has included a condition specifying the creation of a Homeowners Association for <br />the five lots created by this development proposal. The duties of the owners association <br />would be limited to maintaining common area known as Parcel A which includes the <br />private road, the bridge, the storm water retention pond and private storm water system. <br />The applicant has expressed concerns in establishing a HOA, in that the financial cost to <br />establish and then to maintain a HOA, specifically the monthly HOA dues, would be <br />considerably high. After many discussions, staff believes that a maintenance agreement, <br />as preferred by the applicant, would not be sufficient for this development as a <br />maintenance agreement is normally used when there is no common land involved. <br />PUD DEVELOPMENT PLAN FINDINGS <br />The Pleasanton Municipal Code sets forth the purposes of the Planned Unit Development <br />(PUD) District and the considerations to be addressed in reviewing a PUD development <br />plan proposal. The Planning Commission must make the following findings that the <br />proposed PUD development plan conforms to the purposes of the PUD District, before <br />making its recommendation. <br />Whether the proposed development is in the best interest of the public health, <br />safety, and general welfare. <br />The proposed project, as conditioned, meets all applicable City standards <br />concerning public health, safety, and welfare, e.g. vehicle access, geologic hazards <br />(not within a special studies zone), and flood hazards. The proposed development <br />plan is designed to be compatible with the adjacent land uses including the City <br />Golf Course area located along the property's east. <br />The proposed development plan is designed in conformance with the Pleasanton <br />General Plan and the Happy Valley Specific Plan designations for this site and all <br />other relevant policies and programs. <br />Detailed geologic studies have been done in conjunction with the Happy Valley <br />Specific Plan and with the proposed development plan which have been peer <br />reviewed and accepted by the City Engineer.
